“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States ... to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”
Section 3 specifically says ‘engaged in’ NOT ‘convicted of.’ Trump’s second impeachment for ‘incitement of insurrection’ is proof of his engagement in insurrection. Though the Republican-led Senate acquitted him in a vote of 57 guilty, 43 not guilty, and just because a 2/3's majority threshold wasn’t reached for conviction, doesn’t mean he didn’t incite the mob to attack the Capitol on Jan 6, 2021.
In his own words: “We must stop the steal” ... “You'll never take back our country with weakness. You have to show strength and you have to be strong.” ... “And if you don't fight like hell, you're not going to have a country anymore.”
In his defense, his lawyers point out these words from Trump: “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”
I contend that he’s not telling the mob to be peaceful and patriotic, only stating what he knows of their intentions. His true ‘instructions’ were as previously stated, ‘fight like hell.’
During the attack on our Capitol, Trump tweeted his followers: ‘...remain peaceful. No violence! We are the party of law and order...’ even though the carnage was well underway. He watched the attack against our democracy unfold on television, gloating, as I understand from testimony given to the January 6th Committee.
And as a last oink in this pig trough, the video he finally released after it became apparent that Pence and Pelosi had survived the attack, and his ploy to remain in power had failed, amounted to ‘giving aid and comfort’ to the enemies of the United States: “We love you. You’re very special...”
